Welcome to Maskani.

These Terms of Service govern your use of the Maskani website, platform and related services.

By accessing or using Maskani, you agree to comply with these Terms. If you do not agree with these Terms, please do not use the platform.

1. About Maskani

Maskani is an online property marketplace that facilitates connections between people seeking properties and property owners, homeowners and accommodation providers.

Maskani may provide tools for:

  • Property discovery
  • Property listing
  • Search and filtering
  • Property enquiries
  • Saved properties
  • Expressions of interest
  • Viewing requests
  • Reviews and feedback
  • Communication between users

Maskani is a technology platform and does not automatically become a party to agreements between users.

2. Eligibility

You must provide accurate information when creating an account or using services that require registration.

You are responsible for ensuring that the information associated with your account remains accurate and up to date.

Where a service has age restrictions or requires parental/guardian involvement, those requirements will apply.

3. User Accounts

Some Maskani features require you to create an account.

You are responsible for:

  • Providing accurate registration information.
  • Maintaining the confidentiality of your login credentials.
  • Protecting access to your account.
  • Not sharing your account with unauthorized persons.
  • Informing Maskani if you believe your account has been compromised.

You are responsible for activities conducted through your account unless they resulted from circumstances outside your reasonable control.

4. Property Listings

Property owners and other authorized listing providers are responsible for the information they publish.

Listings should accurately represent the property, including where applicable:

  • Location
  • Property type
  • Price
  • Availability
  • Amenities
  • Photographs
  • Description
  • Accommodation details
  • Rules and conditions

Users must not knowingly publish false, misleading, fraudulent, unlawful or deceptive information.

Maskani may review, moderate, approve, reject, suspend or remove listings that violate these Terms or applicable laws.

5. Property Verification

Where Maskani identifies a property or owner as verified, the verification status means only that Maskani has completed the particular verification process associated with that status.

A verification badge should not be interpreted as:

  • A guarantee of ownership;
  • A guarantee of property condition;
  • A guarantee of availability;
  • A guarantee of price;
  • A guarantee of legal title;
  • A guarantee of transaction completion; or
  • Insurance against loss.

Users should carry out their own appropriate checks before entering into a property transaction.

6. Property Transactions

Maskani facilitates discovery and communication but does not automatically act as:

  • The landlord;
  • The seller;
  • The property owner;
  • The tenant;
  • The buyer;
  • The accommodation provider;
  • A real-estate agent; or
  • A party to a transaction between users.

Unless specifically stated otherwise, agreements, payments, leases, sales, bookings and other transactions are between the relevant users.

Users should independently verify all material information before making payments or entering into legally binding agreements.

7. Prices and Payments

Property prices displayed on Maskani are provided by listing owners or authorized providers unless expressly stated otherwise.

Prices may change.

Maskani does not guarantee that a displayed price will remain available after you contact a property owner.

If Maskani introduces payment functionality in the future, additional payment terms may apply.

Users should never send money to an individual claiming to represent Maskani unless the payment method has been expressly provided or authorized through the official Maskani platform.

8. Communication and Enquiries

Users may use Maskani to send enquiries, interests or viewing requests.

Users must not use these features to:

  • Harass other users;
  • Send spam;
  • Send fraudulent messages;
  • Request unlawful activities;
  • Send malicious links or files;
  • Impersonate another person; or
  • Attempt to obtain another person's confidential information.

Maskani may investigate reports of abuse or misuse.

9. Property Viewings

Where viewing requests are available, Maskani may provide tools for users to request, accept, decline or reschedule viewings.

Maskani does not guarantee that a viewing will take place.

Users should exercise appropriate personal safety precautions when meeting people they have contacted through the platform.

10. Reviews and User Content

Users may be permitted to submit reviews, comments, photographs or other content.

You agree that content you submit:

  • Is truthful to the best of your knowledge;
  • Does not infringe another person's rights;
  • Does not contain unlawful or abusive material;
  • Does not contain malicious software;
  • Does not impersonate another person; and
  • Is not submitted for fraudulent purposes.

Maskani may remove content that violates these Terms.

11. Prohibited Activities

You must not use Maskani to:

  1. Publish fraudulent property listings.
  2. Misrepresent ownership or authority over a property.
  3. Provide intentionally false property information.
  4. Scam or defraud another user.
  5. Harass, threaten or abuse another user.
  6. Circumvent platform security.
  7. Attempt unauthorized access to another account.
  8. Upload malicious software.
  9. Scrape or systematically copy platform data without authorization.
  10. Use Maskani for unlawful activities.
  11. Create accounts for deceptive purposes.
  12. Manipulate reviews or ratings.
  13. Upload photographs or material that you do not have permission to use.

12. Listing Moderation

Maskani reserves the right to review listings and user accounts.

We may:

  • Approve a listing;
  • Reject a listing;
  • Request additional information;
  • Suspend a listing;
  • Remove a listing;
  • Suspend an account; or
  • Restrict access to certain features.

These actions may be taken where there is a reasonable concern about fraud, inaccurate information, misuse of the platform, security, safety or violation of these Terms.

13. Intellectual Property

The Maskani name, branding, logo, website design, software, platform features and original content are owned by or licensed to Maskani unless otherwise stated.

You may not reproduce, modify, distribute, sell or commercially exploit Maskani's proprietary content or software without appropriate authorization.

Property owners retain responsibility for and, where applicable, ownership of content they upload to the platform.

By uploading content, you grant Maskani permission to use, display, store and process that content for the purposes of operating and promoting the Maskani platform, subject to our Privacy Policy and any applicable rights.

14. Third-Party Services

Maskani may use third-party services to operate certain features, such as hosting, authentication, cloud storage, analytics, maps, communications or other technology services.

The availability of such services may affect certain Maskani features.

Third-party services may have their own terms and privacy policies.

15. Platform Availability

We aim to keep Maskani available and reliable, but we do not guarantee uninterrupted access.

The platform may occasionally be unavailable because of:

  • Maintenance;
  • Technical problems;
  • Security incidents;
  • Internet or hosting failures;
  • Third-party service interruptions; or
  • Circumstances outside our reasonable control.

16. Disclaimer

Maskani provides a platform for property discovery and communication.

We do not guarantee:

  • The accuracy of every listing;
  • Property ownership;
  • Property condition;
  • Availability of a property;
  • Accuracy of photographs;
  • Accuracy of prices;
  • The conduct of another user;
  • Completion of a transaction; or
  • Suitability of a property for a particular user.

Users are responsible for conducting appropriate checks before making decisions or entering into transactions.

17. Limitation of Responsibility

To the extent permitted by applicable law, Maskani is not responsible for losses arising from transactions, communications or arrangements made directly between users.

Nothing in these Terms is intended to exclude or limit liability where doing so would be unlawful.

18. Account Suspension and Termination

You may stop using Maskani at any time.

Maskani may suspend or terminate access where a user:

  • Violates these Terms;
  • Engages in fraudulent activity;
  • Creates a security risk;
  • Misuses the platform;
  • Provides materially false information; or
  • Uses Maskani for unlawful purposes.

19. Privacy

Your use of Maskani is also subject to our Privacy Policy, which explains how we collect, use, store and protect personal information.

20. Changes to These Terms

We may update these Terms from time to time.

When significant changes are made, we will provide appropriate notice through the platform or other reasonable means.

Your continued use of Maskani after updated Terms take effect means that you accept the revised Terms.

21. Governing Law

These Terms shall be interpreted in accordance with the applicable laws of Kenya.

Where a dispute arises, the parties should first attempt to resolve it through good-faith communication.

Nothing in these Terms prevents a user from exercising rights available under applicable law.
